Motorcycle Accidents

A motorcycle accident is often more treacherous and devastating than an auto accident due to the motorcyclist’s physical exposure to the colliding vehicle or object. Although motorcyclists are often stereotyped as reckless and fast drivers, it’s negligent automobile drivers who statistically cause most motorcycle accidents.  The failure of motorists to detect and recognize motorcycles in traffic is the predominate cause of motorcycle accidents. The driver of the other vehicle involved in the collision with the motorcycle did not see the motorcycle before the collision, or did not see the motorcycle until it was too late to avoid the collision.

The National Highway Traffic Safety Administration reported that in 2003 there were 3,661 motorcyclists killed, and an additional 67,000 were injured in traffic crashes in the United States—12 percent more than the 3,270 motorcyclist fatalities and 4 percent more than the 65,000 motorcyclist injuries reported in 2002. Additionally, more than 100,000 motorcyclists have died in traffic crashes since the enactment of the Highway Safety and National Traffic and Motor Vehicle Safety Act of 1966.

However, because of the perceived increased dangers associated with motorcycles, the victim’s rights in a motorcycle accident may be tough to defend, even if the cause is the other party’s negligence.  If you or someone you love has been in a motorcycle accident, the same laws apply as if you were in a car or truck.  These laws require that the person or company responsible pay for your motorcycle accident repairs and injuries. It is important you understand the dangers associated with motorcycles and the rights you have if you’re ever in a motorcycle accident.

Our Miami motorcycle accident lawyers have been handling motorcycle accident cases for over thirty years.  Just one of our successful cases involved a 21 year old who was injured when a driver violated the right of way.  The policy limit was only $100,000, but our firm alleged that the insurance company acted in bad faith.
